Withdrawal from the contract for a booked trekking or hiking trip (in accordance with the General Travel Conditions ARB 1992) 1.1. Withdrawal by the customer before the start of the trip a) Withdrawal without cancellation fee Apart from the legally granted right of withdrawal, the customer can withdraw from the following cases that occur before the start of the service, without the organizer having any claims against him: If essential elements of the contract, to which also the travel price counts to be changed considerably. In any case, the thwarting of the stipulated purpose or character of the travel event, as well as one according to section 2.1. Increase in the agreed travel price by more than 10 percent such a change in the contract. The organizer is obliged to either immediately explain the change to the contract directly to the customer and to instruct him about the existing option either to accept the change to the contract or to withdraw from the contract; the customer has to exercise his option immediately. If the organizer is at fault for the occurrence of the event that entitles the customer to withdraw, the organizer is obliged to pay compensation to the customer. b) Entitlement to compensation The customer can, if he does not make use of the withdrawal options according to lit. the organizer is able to provide this service. In addition to the right to an option, the customer is also entitled to compensation for non-performance of the contract, unless the cases of the 2nd come into effect. c) Withdrawal with cancellation fee The cancellation fee is a percentage of the travel price and its amount depends on the time of the declaration of cancellation and the respective type of travel. The total price of the contractually agreed service is to be understood as the travel price or package price. In all cases not mentioned under letter a, the customer is entitled to withdraw from the contract against payment of a cancellation fee. If the cancellation fee is inadequate, it can be moderated by the court. Depending on the type of trip, the following cancellation rates apply per person: 1. Special flights (charter), group IT (group flat-rate trips on scheduled services), bus company trips (multi-day trips) up to the 30th day before the start of the trip ............ ....................... 10% from 29th to 20th day before departure ................ .......... 25% from 19th to 10th day before departure .......................... 50% from 9th to 4th day before departure ............................. 65% from the 3rd day (72 hours) before departure .............. 85% of the travel price. 2. Individual IT (individual package tours in scheduled services), rail company trips (except for special trains) up to the 30th day before departure ........................... ........ 10% from 29th to 20th day before departure .......................... 15% from 19. up to 10th day before departure .......................... 20% from 9th to 4th day before departure ....... ...................... 30% from the 3rd day (72 hours) before departure .............. 45 % of the travel price. Special conditions apply to hotel accommodation, holiday apartments, boat trips, one-day bus trips, special trains and scheduled flights at special rates. Declaration of withdrawal When withdrawing from the contract, please note: The customer (client) can at any time inform the organizer with whom the trip was booked that he is withdrawing from the contract. In the event of cancellation, it is advisable to do so - by registered letter or - in person with a simultaneous written declaration. d) No-show No-show occurs if the customer does not leave because he lacks the will to travel or if he misses the departure because of negligence or a coincidence. Cancellation by the organizer before the start of the trip a) The organizer is released from the fulfillment of the contract if a minimum number of participants specified in the advertisement is not reached and the customer has been notified in writing of the cancellation within the deadlines specified in the description of the tour event or the following deadlines: - up to the 20th day before the start of the trip for trips of more than 6 days, - up to the 7th day before the start of the trip for trips of 2 to 6 days, - up to 48 hours before the start of the trip for day trips. If the organizer is to blame for the failure to achieve the minimum number of participants beyond slight negligence, the customer can demand compensation; this is flat-rate with the amount of the cancellation fee. The assertion of damage in excess of this amount is not excluded. b) The cancellation is due to force majeure, ie due to unusual and unforeseeable events over which the party invoking force majeure has no influence and the consequences of which could not have been avoided despite exercising the necessary care. This does not include overbooking, but government orders, strikes, war or war-like conditions, epidemics, natural disasters, etc. c) In cases a) and b) the customer receives the amount paid back. The right to choose according to 1.1.b, 1st paragraph is available to the. 1.3. Withdrawal by the organizer after the start of the trip The organizer is released from the fulfillment of the contract if, in the context of a group trip, the customer persistently disrupts the execution of the trip through grossly improper behavior, regardless of a warning. In this case, if the customer is at fault, he is obliged to compensate the organizer for the damage. 2. Changes to the contract 2.1. Price changes The organizer reserves the right to increase the travel price confirmed with the booking for reasons that do not depend on his will, provided that the travel date is more than two months after the conclusion of the contract. Such reasons are exclusively the change in transport costs - such as fuel costs - the charges for certain services, such as landing fees, embarkation or disembarkation fees in ports and corresponding fees at airports or the exchange rates to be used for the travel event in question. In the event of a price reduction for these reasons, this must be passed on to the traveler. Price increases can only be made within the two-month period if the reasons for this were negotiated in detail at the time of booking and noted on the booking slip. There are no price changes from the 20th day before the departure date. A price change is only permitted if, if the agreed conditions are met, precise information on the calculation of the new price is provided. Price changes and their circumstances are to be explained to the customer immediately. If the travel price changes by more than 10 percent, the customer can withdraw from the contract without a cancellation fee (see Section 1.1.a.). 2.2. Changes to services after the start of the trip - In the event of changes for which the organizer is responsible, the provisions as set out in Section 5 of the General Terms and Conditions (legal basis in the event of service disruptions) apply. - If, after departure, it turns out that a significant part of the contractually agreed services will not or cannot be provided, the organizer must take reasonable precautions without additional remuneration so that the tour can continue. If such precautions cannot be taken or if they are not accepted by the customer for valid reasons, the organizer must, if necessary, provide an equivalent option for transporting the customer to the place of departure or to another location agreed with him without additional payment . In addition, the organizer is obliged to provide the customer with assistance to overcome difficulties in the event of non-fulfillment or inadequate fulfillment of the contract. 3.
